IHAB AL RIFAI (ABU DHABI)

The Abu Dhabi Civil Family Court has issued a Dh5,000 fine to a woman for repeatedly insulting and verbally assaulting a man.

The plaintiff in question filed a lawsuit in which he demanded that the defendant pay Dh50,000 in compensatory damages for the emotional distress he alleged that he had suffered due to the defendant’s behaviour.

The plaintiff stated that the defendant had repeatedly threatened and verbally assaulted him, prompting criminal charges to be filed against her, of which she was found guilty.

In the ruling, the court affirmed that perpetrators are liable for any harm caused to another, including emotional or moral damage, which includes anything that harms the dignity, feelings, or honour of another, including psychological distress.

The court found that the case satisfied the legal elements of moral damage, finding that the defendant had verbally assaulted the plaintiff as was stated in the criminal proceedings and that the verbal harassment had resulted in emotional and moral damage on the part of the plaintiff, represented by distress and fear, leading the court to order compensation of Dh5,000 to be awarded to the plaintiff.

The court ruled that the defendant was obligated to pay the Dh5,000 in compensatory damages as well as attorney’s fees and expenses, and rejected all other requests.
