DUBAI (WAM)

The Ministry of Human Resources and Emiratisation (MoHRE) recently organised an informative workshop for legal department employees from various private-sector companies and media organisations. The workshop aimed to shed light on the procedures for settling labour disputes, aligning with Federal Decree Law No. 20 of 2023, which amends specific provisions of Federal Decree Law No. 33 of 2021 regarding the regulation of employment relationships, In addition to Federal Decree-Law No. 21 of 2023, which amends certain provisions of Federal Decree-Law No. 9 of 2022 concerning domestic workers.

Held at MoHRE's Dubai headquarters, the session was conducted in both Arabic and English, focusing on raising awareness among private-sector legal departments about relevant legislation concerning labour disputes. The workshop emphasised the crucial importance of abiding by these laws.

MoHRE resolves labour disputes through a final decision with executive order status, contingent upon meeting specific criteria. Notably, this includes disputes with a total value of Dh 50,000 or less, or cases involving non-compliance with a previous amicable settlement decision issued by MoHRE, regardless of the claimed amount.

For disputes exceeding Dh 50,000, MoHRE continues its practice of seeking amicable settlements. Cases where such settlements cannot be reached are referred to the relevant court for resolution.

These initiatives form part of ongoing efforts to develop legislation continuously, enhancing the UAE's global competitiveness, reducing the incidence of labour disputes, and expediting their resolution. The ultimate goal is to safeguard the rights of all parties involved in an employment contract, ensuring a fair and transparent legislative environment renowned for integrity and impartiality.

It is noteworthy that the UAE labour market received international recognition in the IMD World Competitiveness Yearbook 2022, where it topped the Lack of Labour Disputes index, as reported by the International Institute for Management Development (IMD) in Switzerland.
