Decision No. 710 outlines eligibility for private teaching work permit

His Excellency Dr. Abdulrahman Al Awar, Minister of Human Resources and Emiratisation, issued Decision No. 710 for the year 2023 regarding the introduction of a private teaching work permit.

The decision mandates the issuance of a document from the Ministry after coordination with the Ministry of Education, which allows qualified individuals to practise private teaching and earn a direct income.

According to the new regulation, five categories are eligible to obtain the private teaching work permit: teachers registered in a public or private schools, public sector employees, unemployed teachers, school students aged between 15 and 18, and university students.

The decision, comprising nine legal articles, specifies two types of conditions that must be met to obtain a private teaching work permit: the first is employer’s approval if the applicant is an employee in the public sector, except for those holding a part-time work permit. The second condition mandates a certificate of good conduct and behaviour and a health fitness certificate, if the applicant is not employed.

The duration of the private teaching work permit is two years and can be renewed provided the same conditions are met. The decision states that the permit is granted without fees and obliges holders to sign a professional practice charter as approved by the Ministry of Education.

The decision calls on beneficiaries of private teaching services to only hire individuals authorised by the ministry, adhering to the decision’s provisions and to pay the agreed financial obligations between the parties.

The decision affirms that fines and penalties stipulated in the Labour Relations Law, its executive regulations, and the decisions regulating them, as well as all applicable laws in the state, apply to anyone practising private teaching without obtaining a permit from the ministry according to this decision.

The private teaching practice charter attached to this decision includes seven clauses that require disclosure of any conflict of interest. It prohibits the teacher from providing service to any student enrolled in the school where they work. As per the mandate, the private teacher must maintain confidentiality of information related to students and parents, forbid the use of verbal or physical violence with students, and avoid topics with abnormal or extremist ideas that are inconsistent with the national identity of the state.

They must also not form any inappropriate relationship, by any means, such as sending emails or pictures to students, and adhere to a modest public appearance in accordance with the traditions of the UAE.

With this new measure, the Ministry aims to enhance the learning process and ensure the governance of private tutoring outside the framework of educational institutions according to effective and organised regulations.

It seeks to ensure the stability of the educational system and provide flexible options for students and parents that meet their needs and aspirations, while maintaining discipline and quality of the educational process and the efficiency of its outcomes.

The introduction of permits for qualified individuals to provide private lessons contributes to reducing illegal and unorganised practices, enhancing the overall learning process.

This model aligns with the best global practices in this field, a result of cooperation and coordination between the Ministry of Education and the Ministry of Human Resources and Emiratisation to ensure a legal framework that regulates the private tutoring sector, preserving the rights of private tutors and ensuring students receive supplemental education in ways most suited to their learning style.

The introduction of the private teaching work permit responds to new developments and specialisations, and ensures their practice within a regulated legal framework that facilitates the work of service providers, and ensures the protection and balance of rights and duties of all parties and enhances ease of business.

Beneficiary categories of this decision can apply for the Private Tutoring Work Permit through the smart application of the Ministry of Human Resources and Emiratisation, its website, and the ministry’s electronic system.
