IHAB AL RIFAI (AL AIN)

The Al Ain Court of First Instance has ordered a former company employee to repay Dh328,285.65 to her previous employer after being found guilty of embezzlement. 

The court's decision comes following a lawsuit filed by the company, which accused the employee of misappropriating funds meant for purchasing wastepaper from suppliers.

The plaintiff alleged that the defendant, upon her employment, received Dh491,786 but failed to use the entire amount for its intended purpose, instead diverting Dh330,805 for personal use. 

The criminal judgment previously convicted the defendant of the offense, leading to the civil lawsuit to recover the embezzled funds.

While the company sought additional legal interest at a rate of 9% annually, the court denied this request, citing insufficient grounds for its entitlement. However, the defendant has been mandated to cover all legal fees and expenses, as stipulated by Article 133 of Federal Decree-Law No. 42 of 2022 on the Civil Procedure Law.
